Store Policy of Digital Media West


PLEASE READ CAREFULLY as this applies to all purchases made from Digital Media West.

By accepting charge(s) of any product(s) made from Digital Media West, customers (buyers) agree to be bound by the terms and conditions listed below. Any attempt to alter, supplement, modify or amend these terms and conditions by the customer will be considered as material alteration of this agreement and, therefore, are void with/without customer’s acknowledgement. In addition, these terms and conditions are subject to change at any time, with or without prior written notice to the customer(s). Therefore, please check these terms and conditions carefully each time before you place an order from Digital Media West.

Technical Support

Digital Media West, does not offer any technical support on any products that it sells. Digital Media West does not take any responsibilities due to misleading or misunderstanding technical information. Customers (buyers) shall contact the original manufacturer, if any, for assistance such as compatibility, suitability, playability and any other technical questions.

LIMITED REFUND GUARANTEE

Each returned merchandise(s) that has been returned or has been requested to return MUST follow appropriate return merchandise procedures. Any returned merchandise that has not followed our “Product Return Procedure” may be rejected and returned to customer at customer’s expense. Customer agrees that all returned products will be 100% complete, in re–saleable condition, and will include the original packaging material(s), manual(s), blank warranty card(s), and other accessories which have provided by the manufacturer originally in the packaging. If any component(s) of the returned product is (are) missing, Digital Media West may reject the entire return or may choose to impose additional charges against the customer for replacement of the missing component with or without customer’s acknowledgment. Digital Media West will gladly accept any defective merchandise within 15 days of purchase.

IMPORTANT: Digital Media West, located at 30941 W. Agoura Rd., Westlake Village, CA 91361, may refuse any returning packages which DO NOT HAVE a Return Merchandises Authorization number on them. Any such packages may not be processed and may be sent back to sender at sender’s expense.

PRODUCT RETURN PROCEDURE

To return a product, (“DEFECTIVE or NON–DEFECTIVE”), you must first obtain an “RMA” (Return Merchandise Authorization), number by calling or e–mailing our customer service department. Digital Media West may choose to not accept returns without prior authorization and an RMA number. Once issued, RMA numbers are valid for 30 days within which return products must be received by Digital Media West. RMA numbers will not be extended or reissued. Customer should prominently display the RMA number(s) clearly on the shipping label of boxes containing the returned product. Customer is solely responsible for shipping any returned product(s) to Digital Media West. Digital Media West may choose to issue a return label for defected items (only) upon RMA department manager’s approval. Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping charges and all risk of loss for the returned product during shipment. Digital Media West will not refund to customer the original shipping charges. For defective items, upon supervisor’s approval, original shipping charges may be credited back depending on special cases. In addition, Digital Media West may assess a 15% restocking fee with shipping cost against the Customer's account on all non–defective returns for refund with or without customer’s acknowledgment.

WARRANTIES

Digital Media West is both a distributor and a manufacturer. On products that we manufacture, we guarantee the product and the workmanship 100%. (Manufactured products include video and disc duplication, authoring and encoding). Distributed products such as tapes and discs may or may not be covered by the manufacturer's warranty, service, and support policy (if any). Digital Media West will assist its customers in warranty related issues but cannot be responsible for any manufacturer warranties information and/or dispute.

LIMITATION OF LIABILITY

IN ALL CIRCUMSTANCES, THE MAXIMUM LIABILITY OF DIGITAL MEDIA WEST IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. DIGITAL MEDIA WEST SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. DIGITAL MEDIA WEST SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT DIGITAL MEDIA WEST IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES. DIGITAL MEDIA WEST DOES NOT, AND IS NOT, RESPONSIBLE FOR ANY LOST DATA, ONLINE ERRORS, DISPLAYING ERRORS, ONLINE PAGE ERRORS OR ANY ONLINE PROCESSING ERRORS THAT HAVE BEEN CAUSED BY MACHINES OR COMPUTERS. DIGITAL MEDIA WEST DOES NOT HOLD ANY LIABILITIES FOR ANY LOSS OF EMAILS DUE TO TECHNICAL ERROR(S).

Order Processing

Digital Media West may contact you regarding the order you have placed. If, for any reason, you cannot be reached, your order may be put on hold. Digital Media West is not responsible for any delays in shipment regardless of the reason for the delay.

LOST OR DAMAGED PACKAGE

Digital Media West does not hold any responsibility for any loss or delay of shipment due to carrier error. Digital Media West, however, will re–ship any lost packages that have not arived within 15 days.

Shipping Methods

Our carrier of choice is UPS. We can, however, use any and all other carriers depending on the situation. UPS, for example, will not deliver to a Post Office Box. Also, they will charge us $7.50 for any incorrect address. If such incorrect address is the fault of the customer, the customer will be charged.

Cancellation of ORDERS

If you need, for any reasons, to cancel your order, you must call us before the order has been shipped. Once the order leaves our facility, it cannot be cancelled. We reserve the right to refuse any order.

Privacy Policy

This is easy... We dislike SPAM as much as you do... We do not share or sell any of your information to anyone whatsoever. One possible exception would be giving your name and organization to a supplier for the purpose of making a direct–to–end–user shipment.

Media Duplication

All orders placed with this company by and for the account of the customer, are subject to the following conditions: LIMITATIONS OF LIABILITY OF DIGITAL MEDIA WEST/CLIENT’S RISK. This company respectfully points out that as its prices are never proportionate to the value of the master materials and packaging elements entrusted to it, customer’s materials are received, transferred, duplicated and stored by this company only at customer’s risk, and this company does not accept responsibility for any loss or damage to such master materials or packaging elements from any cause whatsoever. Customer should, therefore, insure all materials delivered to this company against all risks. This company will exercise reasonable care and will exert its best efforts to produce high quality work hereunder, but does not make any warranty nor does it assume any responsibility as to the character or quality of the material or service to be furnished or provided by it hereunder nor as to the results of any of its undertakings hereunder. Without limiting the foregoing in any particular, this company shall not be liable for loss of any kind whatsoever due to delays or failure in performance caused directly or indirectly by acts of nature, terrorism, strikes, failure of transportation agencies, public enemy, the elements, war, insurrection, shortages of labor or materials, government regulations, damage or accident to machinery or equipment, electric power failure, injury or damage to, or loss of, master materials or packaging elements delivered to this company by customer, or any other cause.

Additionally, customer warrants that the material being presented to Digital Media West for copying is not, to his/ her knowledge, protected by copyright owned by another, or that if the material is protected, customer has obtained written prmission of the copyright holder to make copies of the material.

How should I clean and care for DVDs?
Store in a protective case when not in use. Do not bend the disc when taking it out of the case, and be careful not to scratch the disc when placing it in the case or in the player tray. Make certain the disc is properly seated in the player tray before you close it.
